Terms of Service

By accessing or using the iACCESS platform — including the website, mobile application, and iAgent service — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform.

These Terms constitute a legally binding agreement between you and NairoBits Trust, the organisation that operates iACCESS.

iACCESS is designed for young people aged 15 and above. By using the platform, you confirm that you are at least 15 years old. Users under 18 should review these Terms with a trusted adult where possible.

iACCESS is intended for use within Kenya and across Africa. We make no representation that the platform is appropriate or available in all locations outside Kenya.

iACCESS provides the following core services, all of which are free of charge:

• Health Finder — a directory of youth-friendly SRHR providers across Kenya
• iAgent — an AI-powered SRHR health information companion
• Resources — a library of SRHR policies, data, guides, and infographics
• Stories — a space for young people to read and share SRHR lived experiences

We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with reasonable notice where possible. We will not be liable for any interruption or discontinuation of services.

By using iAgent, you understand and agree that:

• Responses are generated by artificial intelligence and may not always be accurate or complete
• iAgent does not replace professional medical consultation, diagnosis, or treatment
• In case of emergency, contact emergency services or visit the nearest hospital immediately
• Conversations may be stored and reviewed for quality improvement (anonymised)

Some features of iACCESS require account registration. When you create an account:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your password
• You agree to notify us immediately of any unauthorised access to your account
• You may not use another person's account without permission

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

You agree not to use iACCESS to:

• Post or share content that is unlawful, harmful, threatening, abusive, or defamatory
• Harass, intimidate, or discriminate against other users
• Share personal health information about others without their consent
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorised access to any part of the platform
• Use automated systems or bots to access or scrape the platform
• Interfere with the proper functioning of the platform

We encourage respectful and supportive interactions. Content that violates these rules may be removed, and offending accounts may be suspended.

All content on iACCESS — including text, graphics, logos, icons, images, and software — is the property of NairoBits Trust or its content suppliers and is protected by copyright and other intellectual property laws.

You may:

• View, download, and print content for personal, non-commercial use
• Share links to iACCESS content on social media
• Use our educational resources in schools and community programmes (with attribution)

You may not:

• Reproduce, duplicate, copy, sell, or exploit any content for commercial purposes
• Modify, translate, or create derivative works from our content
• Remove any copyright or proprietary notices from materials

By submitting stories, feedback, or other content to iACCESS, you grant us a non-exclusive, royalty-free licence to use, display, and distribute that content on our platform.

iACCESS does not:

• Provide medical diagnosis or prescribe treatment
• Recommend specific healthcare providers as superior to others
• Guarantee the accuracy or completeness of provider listings
• Assume liability for health decisions made based on platform information

iACCESS accepts voluntary donations to support our mission. All donations are:

• Processed securely through third-party payment providers
• Non-refundable unless processed in error
• Used transparently to improve platform services and reach

iACCESS is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The platform will be uninterrupted, timely, secure, or error-free
• The results obtained from using the platform will be accurate or reliable
• Any errors in the platform will be corrected

To the maximum extent permitted by law, NairoBits Trust shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of iACCESS.

We may terminate or suspend your access to iACCESS immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the platform will immediately cease
• We may delete your account and associated data (subject to legal retention requirements)
• Provisions of these Terms that by their nature should survive termination shall survive

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

We may revise these Terms at any time. When we make significant changes:

• We will post the updated Terms on this page with a new effective date
• We will notify active users where practicable
• Continued use of iACCESS after changes constitutes acceptance
